FIXING COURT CORRUPTION // LAW PROFESSION REFORM
Ryan believes it's time for lay people to take control of the courts and the legal system. The people must strip regulatory powers away from the Bar Associations, and then reign in the entire profession, including attorneys, judges, and persons in their employ. The people have every right to regulate what goes on in the courtrooms they own, but right now, for most purposes, the entire profession has placed itself above the law. That problem can't be solved by one congressional representative acting alone; however, if elected, Joe Ryan would provide at least one vote in favor of reigning in and controlling the bar, using any available means.
The Supreme Court seems to be made up of the perfect mix of Corporate protectors combined with protectors of Socialism, to ensure that faith in our government will decline and almost every decision handed down from on high will be tainted with the Ivy league bias and East Coast mentality that's fostered the creation of most of the problems our nation's problems. They protect the looting of America by Wall street and the perpetuation of socialism, by running interference for unconstitutional programs that encourage unhealthy and unproductive economic trends and undue government interference with private rights, guaranteed in the constitution, but being ignored by the Supreme Court, as a matter of convenience.
The California's Supreme Court's decision in Rusheen V. Cohen, handed down in 2007, was a green light to attorneys of the California Bar, allowing the members to commit crimes at-will against the public, to cheat in every case in order to win, to break court rules and other restrictive laws as they please, and to not ever fear that any abusive actions they get caught committing, will ever cost them a dime. The decision turns attorneys who abuse the public, into closely and carefully protected legal goons, able to prey upon the citizenry for fun.
In the criminal courts arena, persons with close connections to powerful Republican and Democratic Party power-brokers are seemingly immune from all prosecution. Wealthy defendants use attorneys to hassle prosecutors into dropping cases for untoward reasons, and when convicted of a crime, they always get out on bail while appeals are filed, and they always get to go home to await sentencing. Then they get to spend some extra free-time with their family before they have to report to the Country Club type facility, looters of our economy are typically housed in.
Meanwhile, regular folks are hauled-off to jail immediately at the end of their criminal trials, to languish in a heavy-security prison, without any chance to say goodbye to their family. Perhaps that's appropriate, but there shouldn't be an exemption from immediate confinement that's based upon wealth considerations.
LOCAL PROBLEMS WITH OUR JUDICIARY AND BAR MEMBERS:
Sneaky, corrupt plea bargain deals between prosecutors, Judges, and crooked defense attorneys are the norm in some particular, local courts, and all across the land. Victims rights are ignored where the victim is not famous, or where the victim doesn't have a powerful, well-connected attorney to protect them from other club members.
If elected, Joe Ryan would work at correcting corruption in courts located within the 52nd District by examining the practices of various Superior Court judges, so if there are any miscreants or legal thugs working on the bench, we can be cull them from the ranks, by whatever legal means the community has at it's disposal. Joe Ryan would use the power and influence of his office to organize a group-recall of all the judges currently sitting on the bench in San Diego County who do not exercise their duty and right to impose sanctions on attorneys who violate the law and who violate Court rules; since it only takes approximately eighty-thousand people to signing petitions in a six-month time-period, to bring them all to justice at once.
Joe Ryan's proposed solution to problem:
If elected, Joe Ryan would try and organize efforts aimed at taking jurisdiction over disciplining attorneys away from bar associations (fellow attorneys) and place it back in the hands of public bodies where it belongs.

** September 8th, 2008. A federal judge awards Enron lawyers 655 million in fees (approximately 350.00 dollars an hour for 300,000 hours of work they supposedly did on the case). Gee, I wonder who kept track of the billable hours?. A large portion of the money will go to a man sitting in federal prison (Bill Lerach). The federal judge praised their work and he says the lawyers earned every penny they'll be paid; even though they claimed 40 billion in damages and only got 8 billion or so (in damages) in the end.
If a house worth 500k burnt down, and you sued the insurance company for 500k, and in the end you only got awarded 100k, wouldn't that indicate your attorney screwed up the case or misinterpreted the evidence? |
